1. Agreement
These terms apply to everyone who requests, administers or signs in to a workspace on Easy Lend (the “Service”). By requesting a workspace, signing in, or paying for a subscription, you agree to them on behalf of yourself and the organisation the workspace belongs to. If you do not agree, do not use the Service.
2. The Service
Easy Lend is software for recording a contribution pool and its loans: contributions, loans, interest, repayments, receipts, contracts, expenses, reports and reminders. It is a record-keeping tool. We are not a bank, lender, savings scheme, or financial, legal or tax adviser, and we do not hold, move or lend any of your group's money.
Each organisation gets its own workspace. Workspace requests are reviewed, and we may approve or decline any request. Your organisation is responsible for how it runs its pool, for the agreements it makes with its contributors and clients, and for complying with the laws and regulations that apply to it in Ghana.
3. Accounts and access
- The person who requests a workspace becomes its first Administrator and is responsible for who they invite and what role each person gets.
- Keep passwords confidential. You are responsible for everything done through your workspace's accounts.
- Information you give us when requesting a workspace must be accurate.
- Tell us promptly if you believe an account has been misused.
4. Acceptable use
You must not use the Service to:
- break any law, including laws on lending, consumer protection, data protection or fraud;
- record or message people without the right to do so, or send spam through WhatsApp or email;
- try to reach another workspace's data, probe or overload the Service, or get around its limits or security;
- resell or copy the Service without our written permission.
We may suspend or close a workspace that breaks these rules.
5. Free trial
A new workspace gets a free trial of 14 days with every feature, starting on the day it is approved. When the trial ends without a paid plan, the workspace becomes read-only: you can still sign in, view and download your records, but you cannot record anything new until you subscribe.
6. Subscriptions and payments
- Paid plans are charged in Ghana cedis, monthly or yearly, in advance, through our payment provider (Paystack).
- A subscription covers the period you paid for. It does not renew automatically; renew before it ends to keep full access.
- Upgrades take effect straight away and are charged the prorated difference. Downgrades start when the current period ends.
- When a subscription ends without renewal, the workspace becomes read-only as described above.
7. No refunds
All payments are final and non-refundable. This includes unused time when you downgrade, stop using the Service, or your workspace becomes read-only or is closed, and payments for periods in which you did not use the Service. We may, at our sole discretion, make an exception (for example, for a duplicate charge caused by an error on our side), but no exception creates a right to a refund in any other case. Nothing in these terms limits any right to a refund that the law of Ghana gives you and that cannot be excluded.
8. Changes to prices and subscriptions
We may change our prices, plans, or what each plan includes. We will tell every workspace that has paid for a subscription about any such change at least 3 months before it takes effect, by email to the workspace's Administrators and by a notice on the website and in your workspace's billing page. We then remind them at least twice in every month before the change and again the day before. A change never alters a period you have already paid for; it applies from your first payment after the change takes effect. If you do not accept a change, you may stop using the Service before it applies to you.
Until a workspace has paid for a subscription (for example, during its free trial) it has not agreed to any price, so prices may change without this notice; you are always charged the price shown when you pay. We still email workspaces on a free trial about changes scheduled for a later date.
9. Your data
The records in your workspace belong to your organisation. You can view and export them (reports and exports depend on your plan) while your workspace is active or read-only. How we handle personal information is described in our Privacy Policy. You are responsible for having the right to record the personal information of your contributors and clients and to message them.
10. WhatsApp messaging
Easy Lend's WhatsApp messaging is not the official WhatsApp Business Platform from Meta, and it is not endorsed by Meta or WhatsApp. It uses Baileys, an open-source library that connects to WhatsApp the same way WhatsApp Web does.
- To use it, someone in your workspace links a phone's WhatsApp to the workspace as a linked device (by scanning a QR code or entering a pairing code). Messages are then sent from your own WhatsApp number, as you, not from a Easy Lend business account. Your contacts see your number and name.
- The Service only sends the receipts and reminders your workspace sets up. We have no access to your chats or messages: it does not read, download or store your chats, contacts or incoming messages, and chat history sync is switched off. Only the link credentials needed to send are kept, with your workspace.
- You can unlink at any time from your workspace or from Linked devices in WhatsApp on the phone.
- Because this is not an official integration, WhatsApp may change how it works or restrict or ban a number it considers to be sending automated or unwanted messages. You use WhatsApp messaging at your own risk and remain bound by WhatsApp's own terms. We are not responsible for a restricted or banned number or for messages that are not delivered. Message only people who expect to hear from you.
11. Use at your own risk
The Service is provided “as is” and “as available”, and you use it at your own risk. We work to keep it accurate, available and secure, and we back data up daily, but we do not promise that it will be uninterrupted, error-free, or that data will never be lost. Calculations, reminders, receipts, contracts and reports are aids to your own record keeping: check important figures and documents before relying on them. WhatsApp and email delivery depend on third parties and may fail or be delayed.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect or consequential loss, or for loss of money, profits, data, or goodwill, arising from your use of or inability to use the Service, including losses from decisions your organisation makes about contributions or loans. Our total liability for any claim is limited to the amount your workspace paid us in the three months before the claim arose.
13. Suspension and closure
You may stop using the Service at any time. We may suspend or close a workspace that breaks these terms or that stays unpaid, and we may discontinue the Service with reasonable notice. Where possible we will give you a chance to download your records first.
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. Material changes are announced to existing workspaces before they apply; price and subscription changes always follow the 3 months' notice in section 8.
15. Governing law and contact
These terms are governed by the laws of the Republic of Ghana.
Questions about these terms or your data: email billing@easylend.gybsfam.org, or reply to any email we send you.
